Who these Terms cover. These Terms cover visitors, consumer users, builders, organization administrators, merchants, scanner and event staff, and users of PopHops-powered white-label experiences. The sections that apply depend on how you use the services.
1. Agreement and covered services
These Terms of Use (the “Terms”) govern your access to and use of PopHops-operated websites, builder and merchant workspaces, consumer mobile applications, scanner tools, APIs, support experiences, and PopHops-powered public or white-label experiences (together, the “Services”). “PopHops,” “we,” “us,” and “our” refer to the operator of the Services.
By creating an account, accepting an invitation, purchasing or obtaining a pass, or otherwise using the Services, you agree to these Terms. If you use the Services for an organization, merchant, venue, or other entity, you confirm that you are authorized to act for it and that both you and the entity are bound by the applicable sections.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into these Terms. You must provide accurate information, protect your credentials and devices, and promptly report suspected unauthorized access.
- You are responsible for activity performed through your account or an activated scanner session.
- Organization administrators control workspace roles and may add, remove, or restrict members.
- Do not share personal login credentials. Scanner access links may be shared only with authorized event or venue staff.
3. Consumer users, passes, and real-world experiences
Consumer users may discover, obtain, purchase, own, transfer where permitted, and use passes, tickets, coupons, rewards, and related experience content. Availability, eligibility, timing, capacity, location, redemption rules, and included benefits may vary by experience.
- A published or purchased experience may be preserved as a versioned snapshot. Later authoring changes do not necessarily change what an existing owner received.
- A pass, ticket, coupon, or reward is not cash and may be non-transferable, non-refundable, limited, or subject to additional disclosed rules.
- Merchants, venues, organizers, and other third parties—not PopHops—may provide the underlying goods, services, access, or real-world experience.
- You are responsible for checking operating hours, accessibility, travel conditions, age restrictions, safety information, and venue requirements before visiting.
4. Builders and organization administrators
Builders and organization administrators may create campaigns, passes, hops, drops, storefronts, messages, audiences, integrations, and public experiences. You are responsible for the accuracy, legality, permissions, fulfillment, and operational readiness of what your organization creates or publishes.
- Publication is an explicit action. Review prices, dates, inventory, eligibility, redemption rules, destinations, media, and required disclosures before publishing.
- You must have permission to use uploaded media, trademarks, customer records, destination information, and other content.
- You must configure workspace access according to each person’s role and remove access when it is no longer needed.
- You are responsible for honoring published offers and for communicating material changes to affected users where required.
5. Merchants, venues, scanner staff, and event operators
Merchants and venue operators are responsible for the goods, services, access, discounts, tickets, and other value they agree to provide. Scanner and event staff may use redemption tools only for the organization, location, event, and purpose for which access was granted.
- Confirm the item and status shown before completing a redemption.
- Do not copy, retain, or use attendee or customer information for an unrelated purpose.
- Report suspected fraud, unsafe conditions, or an incorrectly configured offer to the responsible organization.
- A successful scan records an operational event; it does not independently resolve a dispute about the underlying goods or service.
6. Information supplied about other people
If you upload, import, invite, message, or otherwise provide information about another person, you represent that you have a lawful basis and any required notices or permissions to do so. You must use that information only for authorized purposes and comply with applicable privacy, marketing, consumer-protection, and communications laws.
7. Payments, subscriptions, refunds, and taxes
Paid features, subscriptions, passes, tickets, and other transactions may be processed by third-party payment providers. Prices, renewal terms, fees, taxes, cancellation rules, and refund terms presented at checkout or in an order-specific policy form part of these Terms.
- Organizations are responsible for their subscription selections, authorized purchasers, billing contacts, and applicable taxes unless stated otherwise.
- Consumer refund or cancellation rights may depend on the seller, experience-specific rules, and applicable law.
- Chargebacks, fraud, non-payment, or abuse may result in restriction of related access while the issue is reviewed.
8. Content, community features, and feedback
You retain ownership of content you submit. You grant PopHops a non-exclusive, worldwide license to host, process, reproduce, adapt, transmit, and display that content as needed to operate, secure, support, and improve the Services and to carry out your publishing choices.
Do not submit unlawful, misleading, infringing, abusive, discriminatory, sexually exploitative, dangerous, fraudulent, or privacy-invasive content. PopHops may moderate, restrict, remove, or preserve content and account records when reasonably necessary to enforce these Terms, protect people or the Services, respond to reports, or comply with law.
Feedback may be used without restriction or compensation, but it does not transfer ownership of your pre-existing material.
9. AI-assisted features
AI-assisted features may produce incomplete, inaccurate, outdated, or unsuitable drafts. AI output is not legal, financial, safety, accessibility, or operational advice.
- Review and approve AI-assisted content before using or publishing it.
- Verify partner facts, prices, hours, locations, permissions, and claims from authoritative sources.
- Do not submit confidential, regulated, or personal information unless the feature and your authorization permit it.
- PopHops may retain prompts, outputs, review decisions, and provenance information as described in the Privacy Policy and feature-specific notices.
10. Acceptable use
You may not interfere with the Services; bypass access controls, rate limits, entitlement checks, or redemption rules; scrape or automate access without permission; reverse engineer protected portions of the Services except where law permits; introduce malicious code; impersonate others; create fraudulent accounts or redemptions; harass people; or use the Services to violate law or another person’s rights.
11. Third-party services and destinations
The Services may link to or integrate with maps, payment providers, identity providers, media hosts, analytics tools, messaging providers, destinations, merchants, or other third parties. Their services are governed by their own terms and policies. PopHops does not control and is not responsible for third-party content, availability, acts, omissions, or real-world conditions.
12. Privacy
The PopHops Privacy Policy explains how personal information is handled. Privacy acknowledgment is distinct from optional marketing consent and does not waive privacy rights. Organizations using PopHops may have their own privacy obligations and notices.
13. Service changes, suspension, and termination
We may update, add, restrict, suspend, or discontinue features. We may restrict or terminate access for breach, fraud, abuse, security risk, non-payment, legal compliance, or protection of users and the Services. You may stop using the Services at any time and may use available account-deletion controls, subject to records we must or may retain.
Terms that by their nature should survive—including ownership, payment obligations, disclaimers, liability limits, and dispute-related provisions—continue after termination.
14. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” PopHops disclaims implied warranties and does not guarantee uninterrupted operation, destination conditions, merchant performance, availability, results, or that all content is error-free.
To the fullest extent permitted by law, PopHops will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunities arising from the Services. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.
15. Changes and contact
We may update these Terms. We will post the revised version, identify its effective date, and provide additional notice when required. Material changes may require renewed acceptance. If you do not agree to revised Terms, stop using the affected Services.
